Description

The implied consent law, A.R.S. Γ‚§ 28-691 et seq., provides that any person who operates a motor vehicle in this state is deemed to have given consent to certain chemical tests to determine the alcoholic content of his blood if arrested on a charge of driving while intoxicated. The arresting officer must inform the violator that a refusal to submit to the test will result in a suspension of his drivers license. A violator may make a written request for a hearing, the scope of which covers three issues: "whether a law enforcement officer had reasonable grounds to believe the person had been driving or was in actual physical control of a motor vehicle while in this state while under the influence of intoxicating liquor, whether the person was placed under arrest, and whether he refused to submit to the test." A.R.S. Γ‚§ 28-691(E).
